Terms of Use

CaddyChat is an app provided by Ralf Peters (the “Provider”) in Hamburg, Germany. By using CaddyChat the user confirms to agrees to these terms of use.


Usage 

The user can download CaddyChat from the Apple App Store. The user uses the Apple App Store regardless of the provider and the terms of use of the Apple App Store apply.

CaddyChat is made available to the user for free. The premium features of CaddyChat are available via paid subscription.

To use all features, it is necessary that the user is logged into to Apple iCloud, has enough free storage space in the Apple iCloud, an internet service for sending links and an internet connection.

The user is responsible for his or her activities. The user is responsible for the content posted by him or her. CaddyChat may not be used by the user for illegal purposes or in a legal abuse. The user remains the only authorized and responsible person for the content posted by him or her.

The provider endeavors to offer CaddyChat highly available and trouble-free. However, the Provider does not guarantee that CaddyChat or individual features will be available continuously, always, and completely.

The user has not legal entitlement to use CaddyChat. The Provider is entitled to make changes to CaddyChat or discontinue CaddyChat at any time without giving reasons, especially regarding paid features.


Limitation of Liability

The provider assumes no liability for direct or indirect damage caused using CaddyChat or in connection with CaddyChat, subject to mandatory legal provisions. Claims for damages by the user, regardless of the legal reason, as well as his or hers claims for reimbursement of wasted effort are excluded.

The user indemnifies and defend the provider from any liability in the case of violations of these terms of use and in the case of violation of rights and corresponding claims of third parties. In addition, the user pays compensation for any further damage including the costs of necessary legal prosecution and defense.


Final terms

The Provider reserves the right to make changes to these terms of use. The user will be informed of changes in a suitable manner. The user can stop using CaddyChat at any time. If the user continues to use CaddyChat after notification of changes to these terms of use, the changes are considered accepted.

Should any of these terms of use be or become legally invalid, this shall not affect the remaining provisions. Invalid provisions are to be replaced by those that come as close as possible to the intended economic significance of the invalid provision.

These terms of use are governed by the laws of the Federal Republic of Germany. The United Nations Convention on Contracts for the International Sale of Goods is excluded. The place of jurisdiction is Hamburg.
